Aryan Khan
Eight people, including Shah Rukh Khan's son Aryan Khan, have been remanded in judicial custody for 14 days in a cruise drugs party case on October 7. Eight accused, including Aryan Khan, were staying in the NCB (Bureau of Narcotics Control) office. The bail application was heard in the court today (October 8) at 12.56 pm. Apart from Aryan, the court will also hear the bail pleas of Arbaaz Merchant and Moonmoon Dhamecha. During the arguments, Aryan's lawyer Satish Manshinde asked why the central government was in such a hurry in this case. In reply ASG Anil Singh said that you cannot say that. Meanwhile, the NCB team took Aryan to JJ Hospital for a medical checkup and since then, eight accused, including Aryan, have been sent to Arthur Road Jail.
Both the parties in the case have argued that the bail application should not be heard in this court, citing separate cases. Aryan's lawyer Satish Manshinde, meanwhile, said the judge needed to refer the case to a higher bench if there was a dispute, but that did not happen. Aryan's lawyer told the court, "The High Court also grants bail in cases where the quantity of drugs is low. I have not received anything from my client."
ASG (Additional Solicitor General) Anil Singh: We are raising the issue on the basis of maintenance, so answer it first.
Aryan's lawyer (Satish Manshinde): All the arguments will be given at one stage
ASG: That can't happen
Manshinde: You cannot order the court
ASG: When it comes to maintenance, it should be done first
Manshinde: We have presented arguments fully related to remand, not related to maintenance.
The court told Manshinde: You give your arguments on the basis of merit and maintenance, file before you have to say, we will decide
ASG: Please don't say that, usually the one who raises the issue of maintenance first puts the arguments first. The other party then responds
Court: The accused has filed an application with full details
ASG: But this is not the process. Can't I talk about the right process?
Court: Well, we understand, you file your application
Manshinde: No such thing has been seen in recent years. Surprisingly, those who have received nothing are sent to judicial custody.
ASG: If there are 10 accused in one case, only one FIR (First Information Report) is done, even if one accused has a small quantity of drugs and the other does not, but they cannot be separated.
Manshinde: There is no restriction on my client under section 37 of NDPS. Millard You can bail if this is maintainable. Please refer to the 2006 High Court judgment. The High Court grants bail in this case
Satish Manshinde applied to the regular for interim bail
Aryan Khan's lawyer Manshinde has filed two bail applications in the court, one interim and one regular. Aryan Khan's interim bail is being heard in the court of Chief Metropolitan Magistrate RM Nerlikar. Will have to go to special court for regular bail.
The NCB had sought remand till October 11, but the court rejected it. The court granted judicial custody. Aryan's lawyer Satish Manshinde had appealed to the court to hear his bail application. However, the Additional Solicitor General (ASG) objected and the court later refused. The bail application will be heard today (October 8).
The zonal director of the NCB requested the court to keep all the accused in the NCB lockup as the accused could not enter the jail after 6 pm without a cowardly report, leaving the NCB to remand the eighth accused, which the court allowed.
